Arguably, one of the biggest changes announced by the UK government back in December 2023 was under the family migration route. These changes have now been implemented since 11 April 2024. 

But what if you don’t meet the new minimum income requirement? How can you sponsor your spouse?

The answer could be adequate maintenance! 

What is the adequate maintenance?

This allows sponsoring your spouse’s visa even if you don’t meet the minimum income threshold. It applies if the [British] sponsor receives specific UK government benefits like:

  • Carer’s Allowance,
  • Disability Living Allowance (DLA), or
  • or Personal Independence Payment (PIP).
Understanding the test:

It’s a formula: A – B ≥ C

  • A: Your income after taxes and deductions.
  • B: Your monthly rent or mortgage payment.
  • C: The minimum income level for your family size based on Income Support.
Meeting the Requirement:

You simply need to prove your net income (A) can cover housing costs (B) and still meet the minimum income requirement (C). Cash savings held for at least 6 months can also contribute.
